Girl Scout Cookie Pro™ contest 2019 Official Rules ("Official Contest Rules")
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. INTERNET ACCESS RQUIRED.
A PURCHASE OR PAYMENT WILL NOT INCREASE OR IMPROVE CHANCES OF WINNING. VOID WHERE PROHIBITED.
1. CONTEST DESCRIPTION:
The Girl Scout Cookie Pro™ Contest 2019 ("Contest"), solely sponsored by the Girl Scouts of the United States of America ("Sponsor" or “GSUSA”), allows an eligible individual ("Entrant") to highlight her unique cookie story by completing an entry form, which requires answering questions, uploading a mini graphic novel, and providing a photo of herself (“Submission”).
The Sponsor will select twenty-four (24) winners, four (4) per Girl Scout grade level (Girl Scout Daisies, Girl Scout Brownies, Girl Scout Juniors, Girl Scout Cadettes, Girl Scout Seniors, and Girl Scout Ambassadors), from among the Entrants who have provided a complete Submission and who have complied with all of the terms and conditions of these Official Rules ("the Prize Winners").
2. CONTEST PERIOD:
The Contest begins on January 2, 2019, at 12:00 a.m. EST and ends on May 1, 2019 at 3:00 a.m. EST ("Promotional Period"). The Sponsor's clock is the official clock and sole determinant for the purposes of a valid vote in the Contest.
This Contest is open only to registered Girl Scout Cookie Program participants during the 2018/2019 cookie season from participating councils who are legal residents of one of the 50 U.S. states, the District of Columbia, Guam, or Puerto Rico (collectively, “Residents”) (including Residents currently residing in overseas military installations with a valid APO/FPO mailing address) and apply together with a parent or legal guardian who is 18 years old or older as of the date of entry.
If the Potential Prize Winners are under 18 years old (or under 19 years old in Nebraska and Alabama), they must have parental approval to enter the Contest and claim the Prize, which includes the Prize Winners’ parent or guardian providing permission to use the Submission and providing a publicity release consistent with Sections 10 and 11 below. Potential Winners (and a parent or legal guardian) must be available to travel to the state of California from July 24 through July 28, 2019 (“Travel Period”). An Entrant will not be officially declared a Prize Winner until the Entrant or Entrant’s parent/legal guardian has signed all required documentation and can commit to travel during the Travel Period. If an Entrant or an Entrant’s parent or legal guardian is not available to travel during the Travel Period, Potential Prize Winner(s) will not be eligible to win the Prize, and a new Potential Prize Winner will be selected.
The Contest is void where prohibited by law. The Contest is not open to any employees, directors, or officers of the Sponsor, Warner Bros. Entertainment Inc. or of Sponsor’s or Warner Bros. Entertainment Inc.’s parent companies, subsidiaries, or affiliated councils, and the immediate family members (defined as spouse, parent, child, sibling, and their respective spouses, regardless of where they live) and household members (whether related or not) of such employees. The Official Contest Rules are subject to modification by GSUSA at its discretion.
4. HOW TO ENTER:
NOTE: Limit one (1) entry per Entrant.
TO ENTER THE CONTEST DURING THE PROMOTIONAL PERIOD, ENTRANTS MUST:
1. Visit girlscouts.org/cookiepro to review the Official Contest Rules and access Submission instructions.
2. Download the Mini Graphic Novel Tips and Template from girlscouts.org/cookiepro to prepare your unique cookie graphic story.
3. Once you have created your mini graphic novel, submit a complete Submission at girlscouts.org/cookiepro. For a Submission to be considered complete, the Entrant’s Submission or entry form must include the following three components: (1) complete the required set of questions; (2) create a mini graphic novel; and (3) provide a photo of herself.
Questions: Entrants must complete a set of questions that will cover the skills they learned from the Girl Scout Cookie Program®. A set of extra credit questions will also be available at the start of the Promotional Period which provides Entrants with an opportunity to earn extra points. See Section 7 on Winner Determination for more information on the Extra Credit questions. All Entrants will have until the end of the Promotional Period to complete the extra credit questions.
Mini graphic novel: Entrants must upload a mini graphic novel which includes:
i. Illustrations that show their cookie story.
ii. Clearly established settings and characters.
iii. The proper template.
1. Girl Scout Cadettes, Girl Scout Seniors or Girl Scout Ambassadors: must submit two (2) pages of illustrations using the Mini Graphic Novel Template.
2. Girl Scout Daisies, Girl Scout Brownies and Girl Scout Juniors: must submit a single page of illustrations using the Mini Graphic Novel Template.
Personal photo: Entrants must upload a personal photo of only herself that is in portrait form, clear and focused. See additional limitations set forth in the submission photograph guidelines.
The Submission will need to be completed by the Entrant all at once at the time of entry, except for the extra credit question portion. There will not be an opportunity for an Entrant to save her work and finish the Submission later. Sponsor will not be responsible for retrieving any incomplete or lost responses.
Except as otherwise provided herein with respect to the Submission, any other attempted form of online entry is void and will not be accepted. Submissions that in the Sponsor's sole discretion are deemed to be obscene, indecent, incomplete, or inappropriate may be disqualified and removed from the pool of eligible entries. Entrant, or anyone acting on behalf of Entrant, may not offer prizes, awards, gifts, money or consideration of any kind in exchange for votes in the Contest, and Sponsor reserves the right to disqualify any Entrant it believes, in Sponsor's sole discretion, to be engaging in such activity. Any use of automatic, programmed, or like methods of entry (e.g. bots or scripts) will void all Entrants Submissions by such methods. By submitting an entry, Entrants (and, if minors, their parent or legal guardian) hereby agree to the terms and conditions set forth in these Official Rules.
5. MINI GRAPHIC NOVEL SUBMISSION GUIDELINES:
Submitted mini graphic novels must be the original work of the Entrants, must not have won previous awards, must not have been published previously, must not infringe upon any third party’s rights, and must be suitable for publication (i.e., not obscene or indecent). Entrants (and, if minors, their parent or legal guardian) agree not to submit any mini graphic novels in which another person or entity owns any copyright, trademark, patent, trade secret, moral right, or other proprietary right (or where a recognizable product that is protectable by copyright or trademark appears). Such entries shall not be eligible to win this Contest. If a mini graphic novel was created by a person other than the Entrant (or any other material or elements not owned by the Entrant and/or subject to rights of third parties), then the Entrant will be disqualified as the Submission is not the original work of the Entrant. By submitting the mini graphic novel, you are authorizing use of the mini graphic novel in Sponsor promotional materials in accordance with Section 10 contained herein, without compensation to you, or any further permission, or notification, unless prohibited by law. BY SUBMITTING A MINI GRAPHIC NOVEL, THE ENTRANT REPRESENTS AND WARRANTS THAT SHE HAS ALL RIGHT, TITLE, AND INTEREST NECESSARY TO GRANT GSUSA THE WORLDWIDE, IRREVOCABLE, AND UNRESTRICTED RIGHT AND LICENSE TO ADAPT, PUBLISH, USE, EDIT, AND/OR MODIFY THE MINI GRAPHIC NOVEL IN ANY WAY.
6. SUBMISSION PHOTOGRAPH GUIDELINES:
Submission Photographs must be the original work of the Entrant (and, if minors, her parent or legal guardian), must not have won previous awards, must not have been published previously, must not infringe upon any third party's rights, and must be suitable for publication (i.e. not obscene or indecent). Entrants (and, if minors, their parent or legal guardian), agree not to submit any photos in which another owns any copyright, trademark, patent, trade secret, moral right, or other proprietary right (or where a recognizable product that is protectable by copyright or trademark appears). Such entries shall not be eligible to win this Contest. If the photograph includes a person other than the Entrant (or any other material or elements that are not owned by the Entrant and/or that are subject to rights of third parties), then Entrant is responsible for obtaining any and all releases and consent necessary to permit the exhibition and use of the Submission Photograph in the manner set forth in these Official Rules, authorizing use of the photograph by Sponsor in accordance with Section 10 and to feature the winning entry, without compensation, permission, or notification, unless prohibited by law. All written releases so obtained by an Entrant must be provided to Sponsor, in the form provided by Sponsor. An Entrant who is selected as the potential Prize Winner shall not be named the Prize Winner unless and until all such releases have been provided to the Sponsor, if applicable.
7. WINNER DETERMINATION:
The Prize Winners will be selected after the end of the Promotional Period. All Submissions will be evaluated by Girl Scout grade level through a four-round evaluation process starting May 2, 2019:
Round #1: GSUSA will select the six-hundred (600) Entrants with the top scores—100 per Girl Scout grade level— based on their answers to questions detailing their Girl Scout Cookie Program® experience, including how they work with their troop to plan their sale, the skills and channels they employ to run their cookie business, how they choose to invest their cookie earnings to power their troop experiences year-round and how they interact with their cookie customers during their sale.
Round #2: The six-hundred (600) Entrants (“Semi-Finalists”) will move onto a second round of evaluation by a panel of subject matter experts in creative writing who specialize in evaluating the creative writing skills of girls of specific grade levels aligning with their area of expertise. The panel of subject matter experts will rank the Semi-Finalist, based on scoring from the Judging criteria for Round 2, see chart below.
Round #3: From the Semi-Finalists, GSUSA will select one-hundred twenty (120) Verified Entrants (“Finalists”)—twenty (20) per Girl Scout grade level—based on their score and verification. Verification will include confirming Entrant’s membership status with GSUSA, her participation in the Girl Scout Cookie Program during the 2018/2019 Cookie Season and any other verifiable requirements in the Official Contest Rules. Entrants will be disqualified if their submissions don't meet any of the outlined requirements established in the rules.
Round #4: From the Finalists, GSUSA Cookie Pro™ Committee will select twenty-four (24) winners—four (4) per Girl Scout grade level—based on how their complete Submission (answers to their questions and mini graphic novel) illustrates their Cookie program learnings and how they apply their learnings to run their cookie business like a pro. Four (4) runner-ups will be selected for each Girl Scout grade level in case the winning Cookie Pros cannot travel to California for the Cookie Entrepreneur Experience scheduled to take place from July 24, 2019 through July 28, 2019.

The twenty-four (24) winners, four (4) per Girl Scout grade level, will be notified on or before June 10, 2019. Prize Winners will be notified via email by GSUSA within two (2) business days of the selection and will have two (2) business days to claim their Prize with an email response. Winners will also have to comply with all of the terms and conditions of these Official Rules before being awarded the Prize.
Tie-Breaker: In the event of a tie of among two or more Submissions, Entrants will be judged by the GSUSA Cookie Pro Committee on the judging criteria noted above. Sponsor at its sole discretion shall make the final decision to resolve the tie.
The Prize will be forfeited, if the Prize Winner and her parent or legal guardian is unable to travel to California for the Cookie Entrepreneur Experience taking place from July 24, 2019, through July 28, 2019, or does not claim her prize within two (2) business days of being notified, or does not comply with all of the terms and conditions of these Official Rules. Sponsor will select new Prize Winners from among the runner-ups within two (2) business days of the original Prize Winners’ disqualification. Runner-ups will be notified via email starting June 14, 2019 and will have two (2) business days to claim their Prize by responding with an email response to Sponsor. In the event the runner-up of a specific Girl Scout grade level becomes disqualified for the reasons stated in the Contest Official Rules, this process will be repeated until there is a selection of twenty-four (24) winners, four (4) per Girl Scout grade level, who have claimed their Prize within two (2) business days of being notified and who have complied with all of the terms and conditions of these Official Rules.
Sponsor reserves the right for final Prize Winner selection. Sponsor’s decisions about the Contest’s administration and operation and the selection of the Potential Prize Winners are final and binding in all matters related to the Contest. An official external announcement with the twenty-four (24) confirmed Prize Winners, four (4) Top Cookie Pros per Girl Scout level, will be released on or before the week of July 1, 2019 once all Prize Winners are confirmed.
8. PRIZE AND APPROXIMATE RETAIL VALUE ("ARV"):
There will be a maximum of twenty-four (24) winners traveling with one (1) adult chaperone for an all-expenses-paid trip to California (“Cookie Entrepreneur Experience” (Expenses include cost of travel, accommodations, meals, ground transportation, and activities scheduled as part of the Cookie Entrepreneur Experience).Travel expenses cover the cost of roundtrip transportation to and from California (plus one checked bag per person), accommodations for the duration of the Cookie Entrepreneur Experience, a stipend to cover meals not formally hosted by Girl Scouts, and airport transfers and ground transportation for each of the twenty-four (24) winners traveling with one (1) adult chaperone. Each of the twenty-four (24) winners will be recognized as a Top Cookie Pro of 2019 and will have the opportunity to participate in a Cookie Entrepreneur Experience featuring the DC Super Hero Girls and a behind-the-scenes VIP adventure at Warner Bros. Studio (the “Prize”). The total Prize per Prize Winner, including the Cookie Entrepreneur Experience, will not exceed a $14,150 retail value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.
Before claiming the Prize, the Potential Prize Winner must provide all requested forms by the assigned dates to Sponsor at the time of notification. To qualify for the Prize, each Prize Winner must sign and return a Prize Release, which must be received by Sponsor within two (2) days of notification. If a Prize Winner is a minor, then the Prize Winner’s parents or guardian must sign a Prize Release before the Prize Winner receives the Prize. Each Prize Winner must show picture identification to claim the Prize.
The Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion. The Prize is not transferable, assignable or redeemable for cash. The Prize is limited to that specified above; all other unspecified costs, fees, and expenses associated with the Prize award, receipt, and use are solely the responsibility of the Prize Winner. Any and all federal, state and local taxes on the Prize, if any, are the sole responsibility of the Prize Winner. Sponsor reserves in its sole discretion the right to suspend, withhold, modify or terminate any aspect of the Prize at any time, should Sponsor determine that the Prize Winner or Prize Winner’s parent or legal guardian’s conduct violates the values of the Girl Scouts, Girl Scout Promise or Law.
9. OFFICIAL CLOCK AND USE OF INTERNET:
Sponsor's computer will be the official clock for the Contest. Sponsor, Warner Bros. Entertainment Inc. or their respective parent companies, subsidiaries, and affiliates, and their respective advertising, promotion, or production agencies are not responsible for technical, hardware, software, or telecommunications malfunctions of any kind; lost or unavailable network connections; failed, incorrect, incomplete, inaccurate, garbled, or delayed electronic communications caused by the sender; or by any of the equipment or programming associated with or utilized in this Contest which may limit the ability to participate (including but not limited to defects/errors/malfunctions), or by any error that may occur in the entry process or the Contest. Without limiting the foregoing, Sponsor, Girl Scout councils, Warner Bros. Entertainment Inc. or their respective parent companies are not responsible for electronic communications/emails not received due to email filtering, virus protection, other protective devices/apparatuses, or any other cause.
Without limiting the foregoing, for any reason (including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest and renders the Contest incapable of being conducted as described in these Official Rules), Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify, or suspend the Contest in whole or in part. In such event, Sponsor shall make the Prize available in a manner determined by Sponsor in its sole discretion to be fair, appropriate, and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on the Sponsor’s website.
10. INTELLECTUAL PROPERTY AND GRANT OF LICENSE IN MATERIALS SUBMITTED:
Entrant grants to Sponsor, its agents and its licensees the following royalty-free, non-exclusive, perpetual, worldwide, irrevocable license rights to use Entrant’s name, picture, likeness, voice and Submission and all elements of such Entry, including, without limitation, the photo, mini graphic novel, answers to the set of questions, and any descriptions (“Promotional Content”), for advertising and promotional purposes including in any publicity, promotion, or advertising in any form of media, including website (collectively, “Media Accounts”) without further compensation or notification to, or review or permission of entrant and/or any third party.
Entrant also waives any right to inspect or approve any such use of their Submission, moral rights, or rights to attribution. Entrant agrees, where permitted by law, to sign any documents necessary to effect this license grant. Entrant understands and agrees that display or publication of their Submission by Sponsor does not indicate that the Entrant who submitted a particular Submission will be selected as a Prize Winner, and Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such use.
By submitting an entry, Entrants agree to release, discharge, indemnify, and hold harmless Sponsor, Girl Scout councils, Warner Bros. Entertainment Inc. or their respective parent companies, subsidiaries, affiliates, related companies, advertising and promotion agencies, and the directors, officers, employees, shareholders, and agents (“Indemnitees”) of each from and against any liability, injury, death, loss or damages to Entrant or any person or entity, including without limitation damage to personal or real property, caused in whole or in part, directly or indirectly, by reason of their participation in the Contest (or related activities), their acceptance, possession, or use/misuse of the Prize, or from any delay in receiving the Prize and/or any subsequent prize, if applicable. Entrants' obligations to indemnify Indemnitees include actions arising (a) from any allegation that any Submission an Entrant submits via the Contest infringes or otherwise violates the copyright, trademark, trade secret, or other intellectual property or other rights of any third party, or (b) from any other violation of these Official Rules. By entering a Submission, Entrants agree that they have no right to bring (and covenant not to bring) any claim, action, or proceeding of any kind or nature whatsoever against Indemnitees in connection with this Contest. Entrants acknowledge and agree that Indemnitees do not have now, nor shall any of them have in the future, any duty or liability, direct or indirect, vicarious, contributory, or otherwise, with respect to the non-infringement or protection of any copyright, trademark, patent, or any other claimed right or interest or the inaccurate or misrepresentation of information included in the Submission.
13. LIMITATION OF LIABILITY:
Indemnitees are not responsible for: (a) lost, late, damaged, destroyed, delayed, stolen, misdirected, incomplete, or illegible entries, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware, or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or the Contest; or (e) printing, typographical, electronic, or human errors which may occur in the offer or administration of the Contest or the processing of entries. Entrant agrees that any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering the Contests but in no event attorneys' fees or mediation related costs; and Entrant waives all rights to claim any punitive, incidental, consequential, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTESTIS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH INDIVIDUAL FROM THE CONTESTS IF APPLICABLE). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. BY PARTICIPATING IN THE CONTESTS, ENTRANT AGREES THAT THE INDEMNITEES (I) MAKE NO WARRANTY, GUARANTY, OR REPRESENTATION OF ANY KIND, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATING TO THE CONTESTS AND/OR THE PRIZE; AND (II) DISCLAIM ANY IMPLIED WARRANTY.
14. GOVERNING LAW/JURISDICTION:
The Contest is governed by the laws of the State of New York (excluding its principles of conflicts of laws/choice of laws), County of New York and all claims must be resolved individually (NOT PART OF A CLASS) in the appropriate state and federal courts of New York. By participating, you agree to the exclusive jurisdiction of such courts. Sponsor's failure to enforce any provision of these Official Rules shall not constitute the waiver of such provision.
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
